Court Orders Verification of Businesswoman’s Medical Documents in Malicious Damage Case

The Kibera Law Courts have directed an investigating officer to verify the authenticity of medical documents presented by a businesswoman accused of malicious damage to property, after she failed to take plea on medical grounds.

During the court session, Hardy Police Station OCS Luke Muraya expressed disappointment upon learning that the suspect, Mary Waithira Gikonyo, was said to be unwell, noting that she had appeared to be in good health when she left the police station.

“I instructed my officers to escort Ms. Waithira to court, only to find she did not take a plea, allegedly due to illness,” Muraya told the court.

Muraya added that he was further dismayed when the accused failed to appear again on the day set for her plea. He supported the prosecution’s request to authenticate the medical records submitted to explain her absence.

“Your Honour, I doubt the authenticity of the medical documents presented in court. They should be verified,” Muraya stated.

However, the defense lawyer, John Swaka, argued that his client’s health deteriorated after spending a night in police custody, where she was allegedly denied bail. He requested the court to grant two weeks before the next mention, citing the seven days of rest recommended in the medical report.

The court, however, declined to extend the matter by two weeks, instead directing that the accused appear in court on November 4, 2025, to take her plea. The magistrate warned that a warrant of arrest would be issued should she fail to appear.

The investigating officer was also ordered to confirm the authenticity of the medical documents and present the verification report at the next court session.

According to the charge sheet, Ms. Waithira is accused that on March 22, 2025, at Hardy along Kumbe Road in Lang’ata Sub-County, she, together with others not before the court, unlawfully and willfully destroyed a main gate, doors, window panes, and CCTV cameras all valued at KSh 325,000, belonging to Eric Munene.

The case will be mentioned on November 4, 2025, for plea-taking.
